The terms and conditions governing your use of ETX Hosting services

1. Agreement to Terms

By accessing or using any ETX Hosting service, website, or product (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Services.

These Terms constitute a legally binding agreement between you ("Customer", "you") and ETX Hosting ("Company", "we", "us").

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract to use our Services. By creating an account, you represent that you meet these requirements.

If you are using our Services on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

3. Your Account

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Ensuring your account information is accurate and up to date
  • Notifying us immediately of any unauthorised account access

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Services

ETX Hosting provides web hosting, domain management, email hosting, and related services as described on our website. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice.

Service Level

We will use commercially reasonable efforts to make the Services available as described in our Service Level Agreement (SLA). Scheduled maintenance windows will be notified in advance where possible.

Backups

While we perform automated backups, you are solely responsible for maintaining your own backups of all hosted data. We do not guarantee backup availability and our backups are provided as a courtesy only.

5. Acceptable Use Policy

You agree not to use our Services to:

  • Host, distribute, or transmit illegal content
  • Send spam or unsolicited bulk email
  • Host phishing sites, malware, or malicious code
  • Engage in activities that violate intellectual property rights
  • Launch denial-of-service (DoS/DDoS) attacks
  • Mine cryptocurrency without our prior written consent
  • Host adult content without our prior written consent and age verification
  • Conduct activities that degrade our network performance or harm other customers
  • Attempt to gain unauthorised access to any system, network, or data

Violation of this policy may result in immediate account suspension without refund.

6. Payment and Billing

All fees are billed in advance on a monthly or annual basis as selected at signup. By providing payment details, you authorise us to charge your payment method for all applicable fees.

  • Prices are displayed in GBP unless otherwise stated
  • All prices exclude VAT where applicable
  • Renewal fees are charged automatically unless you cancel before the renewal date
  • Failed payments may result in service suspension; a grace period of 7 days applies

7. Refund Policy

We offer a 30-day money-back guarantee on all new hosting plans. If you are not satisfied within your first 30 days, contact us for a full refund of your hosting fees.

The following are not eligible for refunds:

  • Domain registrations and renewals
  • Accounts terminated for Acceptable Use Policy violations
  • Renewals of existing accounts
  • Add-on services purchased separately

8. Uptime Guarantee

We guarantee 99.9% network uptime monthly, excluding scheduled maintenance. If uptime falls below this level due to our fault, you are eligible for service credits as follows:

  • 99.0% – 99.9% uptime: 10% credit
  • 95.0% – 99.0% uptime: 25% credit
  • Below 95.0% uptime: 50% credit

Credits are applied to your account and are your sole remedy for service unavailability.

9. Intellectual Property

You retain all rights to content you upload to our servers. By using our Services, you grant ETX Hosting a limited licence to host, store, and transmit your content solely for the purpose of providing the Services.

ETX Hosting's name, logo, website, and Services are protected by intellectual property law. You may not use our branding without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, ETX Hosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption.

Our total liability to you for any claim arising from these Terms or the Services shall not exceed the amount you paid us in the 3 months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

11. Termination

You may cancel your account at any time from the account dashboard or by contacting support. We may suspend or terminate your account immediately for material breach of these Terms, particularly Acceptable Use Policy violations.

Upon termination, your right to use the Services ceases and we will retain your data for 30 days before permanent deletion, unless required by law to retain it longer.

12. Changes to Terms

We may revise these Terms at any time. Material changes will be communicated by email at least 30 days before taking effect. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
